Rubbish Collection Wandsworth Service Terms

These Terms and Conditions govern the provision of our rubbish collection and related waste removal services within Wandsworth and surrounding areas. By booking a service, you agree to be bound by these Terms and Conditions. Please read them carefully before placing any booking.

1. Definitions

In these Terms and Conditions, the following expressions have the meanings set out below:

1.1 Service means any rubbish collection, waste removal, clearance, loading, transportation, or disposal work provided by us.

1.2 Customer means the person, business, or organisation that requests or pays for the Service.

1.3 Premises means the property, site, or location where the rubbish collection or waste removal is to be carried out.

1.4 Waste means the rubbish, unwanted items, materials, or goods that the Customer instructs us to remove, and which we agree to collect as part of the Service.

1.5 Contract means the agreement between the Customer and us for the provision of the Service, incorporating these Terms and Conditions.

2. Scope of Service

2.1 We provide rubbish collection and waste removal services for domestic and commercial customers, including but not limited to household waste, bulky items, garden waste, and general non-hazardous waste.

2.2 The specific Service, including the volume or type of Waste to be removed and the collection time, will be agreed at the time of booking and confirmed by us.

2.3 We reserve the right to refuse to remove any items that are hazardous, illegal, unsafe to handle, or prohibited under applicable waste regulations.

2.4 Our Service does not include cleaning, repair work, dismantling of fixed structures, or any work not expressly agreed in writing at the time of booking.

3. Booking Process

3.1 Bookings can be made by telephone, email, or online request, where available. The Customer must provide accurate information regarding the type, quantity, and location of the Waste, as well as access details for the Premises.

3.2 All bookings are subject to our acceptance and availability. The Contract is formed when we confirm the booking verbally or in writing, including confirmation of the date, time window, and indicative price or pricing structure.

3.3 Any photographs, descriptions, or information provided by the Customer at the time of booking must be accurate and not misleading. Our quotation is based on the information supplied and is subject to adjustment if the Waste or access conditions differ on arrival.

3.4 We may, at our discretion, require a deposit or pre-authorisation payment to secure the booking. Where this is the case, details will be provided at the time of booking.

4. Access and Customer Obligations

4.1 The Customer is responsible for ensuring that we have safe, adequate, and lawful access to the Premises at the agreed time. This includes arranging any necessary permissions, parking arrangements, and entry codes or keys, where applicable.

4.2 The Customer must ensure that the Premises and the route to the Waste are clear of hazards, and that the Waste is reasonably accessible for loading. We may refuse or delay the Service if access is unsafe or significantly obstructed.

4.3 The Customer warrants that they have full authority either as owner of the Waste or with the consent of the owner to arrange its removal and disposal. The Customer will indemnify us against any claim by a third party alleging lack of authority or ownership.

4.4 The Customer must not include in the Waste any items that we have not agreed to remove or that are prohibited under these Terms, including hazardous, explosive, or environmentally controlled materials.

5. Pricing and Payments

5.1 Our charges may be based on volume, weight, labour time, specific items, or a combination of these factors. An indicative price or price range will be given at the time of booking, based on the information provided by the Customer.

5.2 The final price is confirmed on site once our team has inspected the Waste and assessed the actual volume, type, and access conditions. If the price needs to be adjusted, we will explain the reason and seek the Customer's agreement before commencing the Service.

5.3 Unless otherwise agreed in writing, payment is due immediately upon completion of the Service. We accept payment by cash, debit or credit card, or other agreed methods.

5.4 For business Customers with an account, payment terms will be as agreed separately in writing. If no separate terms apply, payment is due within 14 days of the invoice date.

5.5 We reserve the right to charge interest on overdue amounts at the statutory rate applicable to commercial debts, accruing daily until payment is made in full, and to recover reasonable costs of debt recovery.

6. Cancellations and Amendments

6.1 The Customer may cancel or reschedule a booking by giving us at least 24 hours' notice before the agreed arrival time. No cancellation fee will normally apply where adequate notice is given.

6.2 Where the Customer cancels a booking with less than 24 hours' notice, we reserve the right to charge a cancellation fee to cover administrative and scheduling costs, up to a reasonable proportion of the quoted price.

6.3 If we arrive at the Premises and are unable to carry out the Service due to lack of access, unsafe conditions, or the absence of an authorised person where required, this may be treated as a late cancellation and a call-out or cancellation fee may apply.

6.4 We may cancel or reschedule a booking where necessary due to operational issues, vehicle breakdown, staff illness, severe weather, or other circumstances beyond our reasonable control. In such cases, we will seek to offer a new appointment time as soon as practicable. We will not be liable for any indirect loss arising from such cancellation or rescheduling.

7. Waste Regulations and Prohibited Items

7.1 We operate in accordance with applicable UK waste management legislation and regulations. All Waste collected by us will be transported and disposed of only at authorised facilities, in line with our legal obligations.

7.2 The Customer must not present for collection any of the following prohibited materials, unless we have expressly agreed in writing to handle them under specific terms: asbestos, clinical or medical waste, chemicals, solvents, paints, oils, fuel, gas cylinders, explosives, pressurised containers, radioactive materials, or any other hazardous or controlled substances.

7.3 If hazardous or prohibited items are discovered within the Waste after collection, we may charge additional disposal costs and any associated regulatory or handling fees. We may also return such items to the Customer where reasonably practicable.

7.4 We reserve the right to refuse to collect any Waste that we reasonably believe is unsafe to handle, improperly contained, contaminated with hazardous materials, or otherwise in breach of relevant waste regulations.

7.5 The Customer is responsible for any fines, penalties, or enforcement action arising from misdescription, concealment, or unlawful presentation of Waste that the Customer has provided.

8. Performance of the Service

8.1 We will use reasonable care and skill in performing the Service and will endeavour to arrive within the agreed time window. Time of performance is not of the essence and arrival times are estimates, subject to traffic and operational conditions.

8.2 Our team will take reasonable steps to avoid damage to the Premises while carrying out the Service. However, the Customer should take precautions to protect floors, walls, and fixtures where necessary, particularly in confined or delicate areas.

8.3 The Customer acknowledges that some minor scuffs, marks, or disturbances may occur in the normal course of removing bulky or heavy items, especially where access is restricted. We will not be liable for cosmetic damage that could not reasonably be avoided while exercising due care and skill.

8.4 Risk in the Waste passes to us once it has been loaded into our vehicle. We may, at our discretion, sort, reuse, recycle, or dispose of the Waste in any lawful manner, and the Customer relinquishes all rights and title to the Waste upon collection.

9. Liability and Limitations

9.1 Nothing in these Terms and Conditions limits or excludes our liability for death or personal injury caused by our negligence, for fraud or fraudulent misrepresentation, or for any other liability that cannot be limited or excluded under applicable law.

9.2 Subject to clause 9.1, we will not be liable for any indirect, consequential, or economic loss, including loss of profit, loss of business, loss of opportunity, or loss of goodwill arising out of or in connection with the Service or the Contract.

9.3 Subject to clause 9.1, our total liability to the Customer in respect of all losses arising under or in connection with the Contract, whether in contract, tort, breach of statutory duty, or otherwise, shall in no circumstances exceed the total price paid or payable by the Customer for the specific Service giving rise to the claim.

9.4 We are not liable for any loss or damage arising from circumstances beyond our reasonable control, including severe weather, road closures, traffic incidents, industrial action, or third-party failures.

9.5 The Customer is responsible for ensuring that no items of value or personal belongings are included in the Waste. We accept no liability for loss of any item that the Customer has mistakenly placed within the Waste.

10. Complaints and Disputes

10.1 If the Customer is dissatisfied with any aspect of the Service, they should notify us as soon as possible, providing details of the issue and any supporting information.

10.2 We will investigate all complaints in good faith and aim to respond promptly, proposing appropriate steps to resolve the matter where a fault is identified.

10.3 Raising a complaint does not entitle the Customer to withhold payment of undisputed sums due under the Contract.

11. Data Protection and Privacy

11.1 We collect and process personal data necessary to manage bookings, provide the Service, and handle payments and communications. This may include names, contact details, addresses, and payment information.

11.2 Personal data will be handled in accordance with applicable data protection laws in the United Kingdom. We will take reasonable steps to keep personal information secure and to prevent unauthorised access.

11.3 We may use Customer contact details to send essential service communications and, where permitted, reasonable service-related information. Customers may request that non-essential communications cease at any time.

12. Changes to these Terms and Conditions

12.1 We may update or amend these Terms and Conditions from time to time. Any changes will apply to new bookings made after the date the revised Terms are published or otherwise communicated.

12.2 For ongoing or scheduled Services, we will notify affected Customers of any significant changes that may impact their existing arrangements and will give reasonable notice where practicable.

13. Governing Law and Jurisdiction

13.1 These Terms and Conditions, and any dispute or claim arising out of or in connection with them or the Service, shall be governed by and construed in accordance with the laws of England and Wales.

13.2 The courts of England and Wales shall have exclusive jurisdiction to settle any dispute or claim arising out of or in connection with these Terms and Conditions or their subject matter.

14. General Provisions

14.1 If any provision of these Terms and Conditions is found by a court or other competent authority to be invalid, unlawful, or unenforceable, that provision shall be deemed deleted, but this shall not affect the validity and enforceability of the remaining provisions.

14.2 No failure or delay by us in exercising any right or remedy under these Terms and Conditions shall operate as a waiver of that or any other right or remedy.

14.3 The Contract is between us and the Customer. No third party shall have any rights to enforce any of its terms under the Contracts Rights of Third Parties Act 1999.

14.4 The headings used in these Terms and Conditions are for convenience only and shall not affect the interpretation of the Contract.

By placing a booking for rubbish collection or waste removal, the Customer confirms that they have read, understood, and agree to be bound by these Terms and Conditions.
